General terms and conditions

1. General

1.1 These general terms and conditions (the “General Conditions”) apply when you as a consumer (the “Customer”) place an order via INDISKA Shop Online via the website and related pages, (the “Web Shop”). The General Conditions apply between you and the company within the Indiska group which you enter into an agreement with, depending on where you place the order. The Agreement is concluded with Indiska Magasinet AB, company registration number 556008-5424 except if you place your order from Norway or Finland. If you place your order from Norway you enter into the agreement with Indiska Magasinet AS, company registration number 987 375 507 and if you place your order from Finland you enter into the agreement with Indiska Magasinet OY, company registration number 1700137-6. The company which you enter into the agreement with will hereafter be referred to as “INDISKA”. 

1.2 INDISKA Shop Online does not dispatch any cash purchases for persons under 16 years old and no credit purchases to persons under 18 years old.

1.3 INDISKA reserves the right for any image or typographical errors on the Web Shop. The Web Shop and all its content is owned by INDISKA or its licensors. The information is protected by law with regard to e.g. copyright, marketing and trademarks. This means that trademarks, firm names, product names, images and graphics, design, layout and information on products, services and other content may not be copied or used without the prior written consent of INDISKA.
We reserve the right to adjust any price errors before and after the order is processed.

2. Contracts and orders

2.1 In order to make a purchase via the Web Shop, the Customer must accept the General Conditions. By accepting the General Conditions, the Customer undertakes to comply with the General Conditions and acknowledges that he/she has read the information on personal data and approves the use of cookies according to INDISKA’s Integrity Policy (see below). A purchase contract, for which these General Conditions apply (“Contract”), is not entered into until INDISKA has confirmed the Customer’s order in writing and the Customer has received an order confirmation from INDISKA.

2.2 INDISKA strives to provide the Customer with an order confirmation no later than 72 hours after INDISKA has received an order. However, if an order is placed on a Friday or a holiday, INDISKA tries to confirm the order no later than 6:00 pm the next working day. An order can only be confirmed if INDISKA is able to establish the Customer’s residential address.

3. Customer information etc.

3.1 The Customer confirms that the information the Customer enters is correct and complete. The Customer is responsible for incorrectly entered information.

3.2 The Customer undertakes to ensure that no other party than the Customer is able to use the Customer’s login details. The Customer may not divulge his/her username and password to any unauthorised party and shall ensure that documents containing the username and password are kept in such a way that unauthorised parties cannot gain access to the information. If it is suspected that an unauthorised party is aware of the Customer’s password, the Customer shall immediately report this to INDISKA. The Customer is liable for any purchases made using his/her login details.

3.3 If INDISKA suspects that the Customer uses his/her user account or his/her login details in an inappropriate way or otherwise is in breach of the General Conditions, INDISKA is entitled to suspend the Customer. INDISKA is also entitled, for any reason, to provide the Customer with new login details.

4. Prices, fees and payment

4.1 The prices indicated on the Web Shop apply to orders placed via the Web Shop. All prices are in Swedish kronor (SEK) for Sweden, Norwegian kroner (NOK) for Norway and Euros (€) for other EU countries and include VAT.

4.2 The Customer may pay for his/her order by invoice or card. For each order, the delivery fee applicable from time to time is charged, as indicated on the Web Shop. In the case of payment by invoice, we also charge the invoice fee applicable from time to time, as indicated on the Web Shop. Learn more about our payment methods here.

5. Shipping and delivery

5.1 Articles in stock are normally delivered within five days of the order being placed. INDISKA is responsible for damages incurred in connection with delayed delivery only to the extent this is required in accordance with mandatory law.

5.2 The Customer can pick up his/her package no later than 14 days after receipt of the delivery notice.

6. Right to return and right of withdrawal

6.1 INDISKA always grants the Customer a right to return and/or change the article within 30 days of the delivery date. Returns can only be made at one of INDISKA`s shops in the country from which the article was bought upon presentation of the receipt. For reasons of hygiene this right is not granted for earrings with a broken sealing.

6.2 For purchases of articles via the Web Shop the Customer always has a 30 days withdrawal period from the agreement in accordance with consumer protection legislation (which contains 14 days). This means that you as a Customer have the right to cancel your purchase by notifying INDISKA of this within 30 days of having received the article you ordered.

6.3 You may not exercise your right of withdrawal if you open the packaging of an article, unless this is necessary in order to try or examine the article.

6.4 Customers who wish to exercise their right of withdrawal shall return the article to INDISKA in materially unaltered condition. The Customer is responsible for the article not being damaged while it is in the Customer’s possession and that it is returned in one piece. INDISKA therefore recommends that you send the articles well packaged and in their original box. The article shall be returned within two weeks from the date that INDISKA received the notification of the exercise of the right to cancel.

6.5 The Customer is responsible for the cost and risk of the return. However, INDISKA will reimburse a Finnish Customer for his/her costs of return shipping and assume the risk for articles when required to in accordance with mandatory Finnish law.

6.6 When INDISKA has received the returned article and has established that it is in materially unaltered condition, INDISKA will pay back the amount the Customer paid for the returned article. Shipping costs are not reimbursed for partial returns, except for in Finland in accordance with Finnish law. INDISKA will pay back the amount paid within 14 days of receiving your articles. INDISKA reserves the right to deny the return of an article if it proves not to be in materially unaltered condition.

6.7 Returns shall be made via INDISKA’s distribution centre or to one of INDISKA’s shops in the country from which the order was placed, upon presentation of the receipt or. The Customer may choose to use INDISKA’s shipping option for a shipping fee according to that which is indicated from time to time in the Web Shop. The charge is only intended to cover the shipping cost for the returned articles and will be deducted from our reimbursement to the Customer. For returns to INDISKA’s distribution centre, the accompanying return label shall be attached to the package. The accompanying return form should be used.  

7. Complaints

7.1 Complaints shall be made at one of INDISKA’s shops upon presentation of a receipt, or via INDISKA’s distribution centre.  If a complaint is made via INDISKA’s distribution centre it is encouraged that the accompanying return form is completed and included in the complaint. The attached return label should be used.

7.2 When INDISKA has received an article for which a complaint has been made and established that the complaint is valid, a new article will be dispatched to you. The article will be sent within 30 days of INDISKA’s receipt of your complaint. INDISKA reserves the right to deny an illegitimate complaint. 7.3 INDISKA will pay the cost for return shipping in complaint cases.

8. Governing law and disputes

In the event of a dispute, INDISKA complies with the decisions of the Swedish National Board for Consumer Disputes, The Finnish Consumer Disputes Board, the Danish Consumer Complaints Board and The Norwegian Consumer Disputes Commission. 

Any dispute regarding the interpretation or application of these General Conditions shall be governed by and construed in accordance with the laws of the Customer’s domicile country and settled by the courts of that country.
